Southern New Castle County is one of the most rapidly growing areas in Delaware. Traffic flows continue to increase while road improvements are slow in coming to accommodate the additional traffic.
Blenheim Bayberry Transportation Infrastructure Development Agreement.
- The following pages are excerpts from the Blenheim Bayberry Transportation Infrastructure Development Agreement. As documented in the editorial response by Leann Ferguson, Executive V. P. of the SNCCA, repeated requests were made of local legislators regarding the origin of the language and the basis for the legal authority granted to the Secretary of Transportation to execute said Agreements.
- To date (8-30-05), we have not received any documentation regarding the legal authority and this Bayberry Agreement was provided to the Alliance only after the Alliance notified DelDOT that we were aware of its existence and wanted a copy made available as specified in our FOIA request. Numerous DelDOT staff emails documented in the aforementioned editorial express concerns about the secret and "confidential" nature of this agreement.
- It is important to pay special attention to the fact it was noted in a DelDOT email that the "attorneys for Blenheim homes drafted the Agreement" one of whom is Pamela J. Scott, wife of New Castle County Council President Paul Clark.
- Page 3 of the Agreement commits the Department of Transportation to "commence improvements to the Boyd's Corner Road/ Mt. Pleasant intersection on or before April 19 2005."
- Unlike the Westown Agreement, there is no language in the contract that commits the Developer to a specific schedule of contributions. An email from the SNCCA to DelDOT Legal confirms that no such schedule has been determined.
- Although language in HB 550, Section 112 mandates that all future agreements (subsequent to the Westown Agreement) should be modeled after Westown, the Bayberry Agreement is lacking the most basic component since no clear developer contribution for infrastructure improvements has been determined.
